1. Introduction

These Terms & Conditions ("Terms") govern your access to and use of Kiwikit Service (the "Service"), a cloud-based service & repair shop management software operated by Kiwikit Software ("we", "us", "our"), having its office at 3rd Floor, G. No. 1174, 1175/1/1, Office No. 308, Sai Sanskruti, Baif Road, Wagholi, Pune, Maharashtra – 412207, India.

By creating an account, subscribing to a plan, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. The Service

Kiwikit Service provides software for managing repair-shop operations, including job cards, customer and device records, technician assignment, payments and receipts, reports, and optional customer-notification add-ons (such as WhatsApp/SMS updates). The Service is provided on a subscription basis and is accessed through a web browser; no software installation is required.

3. Accounts & Responsibilities

  • You must provide accurate business and contact information when registering, and keep it up to date.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account, including activity by users you add.
  • You must use the Service only for lawful business purposes and must not attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service or other customers' data.

4. Subscription Plans & Pricing

The Service is offered under subscription plans (currently Starter, Standard and Premium) as published on our website. Each plan includes a fixed number of user accounts; additional users may be added at the published per-user annual rate. All prices are in Indian Rupees (INR) and are subject to applicable taxes.

We may revise plan pricing or features with prior notice. Price changes take effect from your next billing cycle — the price you paid for a current subscription period will not change mid-period.

5. Payments & Billing

  • Subscription fees are payable in advance for the chosen billing period through the payment methods offered at checkout (including UPI, cards and net banking via our authorised payment gateway partners).
  • Add-on services (for example WhatsApp/SMS message credits) are charged separately at the rates communicated at the time of purchase.
  • If a renewal payment is not received by the due date, we may suspend access to the Service until payment is made. Your data is retained during suspension as described in Section 7.

6. Free Trial

We may offer a free trial period (currently 14 days). No payment details are required to start a trial. At the end of the trial, you may subscribe to a paid plan; otherwise your access will be suspended. Trial data is retained for a reasonable period so you can continue seamlessly if you subscribe.

7. Your Data

  • You own your data. All business data you enter into the Service (customers, job cards, payments, reports) remains your property.
  • Each customer's data is stored in a logically isolated database. We take automated encrypted backups daily.
  • You may request an export of your data at any time. After termination of your subscription, we retain your data for up to 90 days before permanent deletion, unless you request earlier deletion.
  • Google Drive backups (optional): the Backup & Restore feature can store encrypted backups in your own Google Drive. You are responsible for maintaining your Google account and any backup files stored in it — files you delete from your Google Drive cannot be recovered by us. Restoring a backup may overwrite current data; you are responsible for confirming restore operations.
  • Our handling of personal data is described in our Privacy Policy.

8. Cancellation & Refunds

You may cancel your subscription at any time; access continues until the end of the paid period. Refunds are governed by our Refund & Cancellation Policy.

9. Service Availability

We aim to keep the Service available at all times and target 99.9% uptime, excluding scheduled maintenance (announced in advance where possible) and events beyond our reasonable control. The Service is provided on an "as is" and "as available" basis.

10. Limitation of Liability

To the maximum extent permitted by law, Kiwikit Software shall not be liable for any indirect, incidental, special or consequential damages, or for loss of profits, revenue or business, arising from the use of or inability to use the Service. Our total aggregate liability for any claim shall not exceed the subscription fees paid by you for the twelve (12) months preceding the claim.

11. Termination

We may suspend or terminate your access if you materially breach these Terms (including non-payment or unlawful use) and do not cure the breach within a reasonable period after notice. You may terminate at any time by cancelling your subscription.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via the Service or email at least 15 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts at Pune, Maharashtra, India.
